Game On, San Jose

The App is intended for users 13 years of age or older. Users under 18 must have permission from a parent or legal guardian to use the App. Certain features of the App, including participation in prize based competitions, may be limited to users who are at least 18 years of age or who otherwise meet eligibility requirements specified in the applicable Promotion.

By using the App, you represent and warrant that you meet the applicable eligibility requirements. SJSA does not knowingly collect personal information from children under 13.

Certain features of the App require account creation. You agree to provide accurate, current, and complete information and to maintain and promptly update such information as necessary.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify SJSA immediately of any unauthorized use
of your account.

SJSA reserves the right to suspend or terminate accounts that violate these Terms or that are suspected of fraudulent, abusive, or unauthorized activity.

The App is provided for personal, non-commercial use only. You agree not to:

• Reverse engineer, copy, modify, or exploit any portion of the App or its content
• Interfere with or disrupt the security, integrity, or functionality of the App
• Use the App for any unlawful, fraudulent, deceptive, or abusive purpose
• Attempt to gain unauthorized access to any portion of the App or related systems

All content available through the App, including videos, games, graphics, text, logos, and software, is owned by or licensed to SJSA and is protected by applicable intellectual property laws.

No ownership rights are transferred to users. Except as expressly permitted, you may not use, reproduce, distribute, or create derivative works from any App content without prior written consent from SJSA.

By creating an account, you agree that SJSA may send you service-related communications, account notifications, and updates regarding App features.

SJSA may also send marketing communications in accordance with applicable law. You may opt out of marketing communications at any time by following the instructions provided in such communications.

The App may rely on third-party platforms and services, including Apple, Google, and other service providers, for hosting, distribution, functionality, and certain features.

SJSA does not control and is not responsible for the policies, terms, or practices of any third-party platforms or services. Your use of such third-party services may be subject to separate terms and conditions.

The App may offer games, contests, promotions, or other prize-based activities (collectively, “Promotions”), including bracket-style competitions.

Participation in any Promotion is subject to additional rules, guidelines, or terms (the “Official Rules”) made available in connection with the applicable Promotion. By participating, you agree to be bound by both these Terms and the applicable Official Rules. In the event of a conflict between these Terms and the Official Rules, the Official Rules will control with respect to the
applicable Promotion.

Promotions may be subject to eligibility requirements, including age and geographic restrictions. Unless otherwise specified in the applicable Official Rules, participants must be at least eighteen (18) years of age to be eligible to receive prizes.

Unless otherwise expressly stated, Promotions are free to enter and no purchase, payment, or donation is required to participate or win.

SJSA reserves the right to modify, suspend, or terminate any Promotion at any time, including due to technical failures, fraud, or circumstances beyond SJSA’s control, and to disqualify any participant who violates these Terms or the applicable Official Rules or engages in fraudulent or abusive conduct.

All decisions regarding scoring, results, and winner selection are final and binding, subject to the applicable Official Rules.

Prizes, which may include tickets, discounts, or other items of value, are subject to availability and any applicable third-party terms and conditions. Certain prizes may be subject to additional restrictions imposed by third-party providers. Prizes are non transferable and may not be redeemed for cash unless expressly stated.

Winners are solely responsible for any applicable federal, state, or local taxes associated with receipt of a prize.

Promotions are void where prohibited or restricted by law.

The App and all content and services made available through it are provided on an “as is” and “as available” basis. SJSA makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included in the App.

To the fullest extent permitted by law, SJSA disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, SJSA shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the App.

This limitation applies to, without limitation, any loss of data, loss of use, interruption of service, or errors in scoring, winner selection, or prize distribution in connection with any Promotions.

SJSA may suspend or terminate your access to the App at any time, with or without notice, for violations of these Terms or misuse of the App.

Upon termination, your right to use the App will immediately cease.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
